Estimados representantes del Pueblo Español en el Parlamento del Estado:

Agradezco estos instantes de atención que me concederán a través de estas palabras, pero creo que es urgente hacerles ver mi posición al respecto de la inminente aprobación de dichas rectificaciones y enmiendas a la susodicha Ley de Economía Sostenible.

Encuentro, al igual que muchas personas que hace tiempo que están expresando su opinión, escritores, expertos en TIC, abogados y demás, quienes rechazan de plano la constitución de una Comisión que estudie específicamente la violación de derechos de autor en páginas web y blogs particulares que se pueden encontrar en Internet de forma libre y gratuita para cualquier usuario con acceso a la misma.

Ya existen otros medios para castigar a quienes infringen esos derechos, ya hay un sistema jurídico que está funcionando de forma muy clara y que está declarando de forma sistemática que esas páginas web de enlaces no violan ninguna ley y que, por lo tanto, no hay razón alguna para cerrarlas o clausurarlas.

Si a los señores Diputados que van a leer esta misiva no les gusta que los jueces digan algo así ante lo que, para ustedes, es algo escandaloso, quizá deberían promover cambios en la LPI o cualquier otra normativa relacionada, no actuando con la creación de una “comisión de expertos” que evalúen lo que actualmente ya están haciendo los jueces, aunque no les guste.

En un Estado de derecho como se presume el nuestro, ya hay una estricta y clara división de poderes para evitar abusos por ninguna de las partes, tal y como ya se demostró en otros momentos de la historia. Hoy ese equilibrio es frágil, y de todos es sabido cómo en muchas ocasiones hemos podido comprobar, a través de los medios, casos de prevaricación en jueces, corrupción en políticos de primera línea, diputados tránsfugas y todo tipo de situaciones que nos pueden hacer plantear muchas cosas, especialmente para nosotros, el pueblo, aquellos quienes les elegimos, y nos sentimos engañados y estafados por un colectivo de personas cada vez más alejados de la realidad y que sólo parecen pensar en la rutina de las elecciones de cada 4 años.

La aprobación de dichas enmiendas, bajo la excusa del respeto a la propiedad intelectual y de explotación de las obras de los diferentes autores que se puedan sentir atacados, esconde a su vez la excusa perfecta para poder luchar contra webs y blogs con otro tipo de contenido que pueda ser considerado ilícito: por ejemplo, podemos luchar contra la pornografía infantil de una forma muy eficaz, cerrando las webs rápidamente sin necesidad de pasar por un proceso judicial. Podemos hacer lo mismo con quienes promuevan el terrorismo o inciten a la violencia, claro que sí, ese tipo de actividades son deleznables y hay que luchar con toda la fuerza posible desde todos los estamentos de la sociedad. Pero, ¿podríamos cerrar también webs (y por lo tanto limitar la libertad de expresión, que, recordemos, se encuentra por encima de los derechos de autor) de crítica política de extrema izquierda? ¿o de extrema derecha? ¿o, por qué no, de ese pequeño grupo de chavales del instituto que pretenden montar una manifestación contra una reforma en su pueblo y que “nos molesta” con su humilde diario de información semanal on-line?

Aprobando esta Ley, estas enmiendas, estas disposiciones complementarias que nada tienen que ver con la Economía Sostenible, estamos abriendo la puerta a que desde la voluntad privada de determinadas personas que serían las que formarían esa comisión de expertos, y que responden a intereses bastante claros, tal y como ustedes mismos han podido comprobar en en anteproyecto de Ley, decidan si podemos cerrar o no una web, foro o blog o cualquier otro medio electrónico de comunicación por el simple e inofensivo hecho de que proporcione a sus usuarios, lectores y visitantes, información que no es de nuestro agrado.

Hablando sin tapujos, podría llegar a crearse un referente como WikiLeaks en España, que destapase fraudes, casos de corrupción que interesasen al conjunto de la Nación, que ayudasen al país a ser más eficaz, a luchar contra esta clase de crímenes, que suponen un robo a toda la sociedad, de una forma muy eficaz. Pero seguramente, con la aprobación de la LES y sus enmiendas podríamos decidir cerrar ese medio de comunicación porque “nos afecta a nosotros, los políticos”, y les puede hacer daño…

Sean valientes, miren hacia el futuro, evalúen las políticas represivas del acceso libre a Internet que se están haciendo en varios países del mundo y valoren ustedes mismos sus consecuencias y los cambios que se están haciendo hoy mismo en ellas. Convirtámonos en un país del siglo XXI y no uno del XIX, miremos hacia adelante, hacia una mundo cada día más interconectado y abierto, donde la información circule libremente y donde no podamos encontrar limitaciones por las razones que argumenta la industria discográfica, audiovisual y editorial ya demostradamente obsoletas si se ciñen a las mismas políticas y formas de actuar que seguían hace 15 o 20 años, cuando los soportes físicos eran una necesidad y no una opción.

En un mundo como el de hoy donde la copia de un disco, una película o un libro tiene un coste nulo (no su creación, por supuesto), estas empresas no pueden pretender seguir ganando lo mismo que ganaban hace ese tiempo, al mismo tiempo que no podemos criminalizar a todas las personas que consuman esos contenidos mal llamados “pirata”. Si así fuese el 100% de la población (y no exagero, bien lo saben ustedes, que en su casa deben también de tener algo “pirateado”) estaría en la cárcel…

Quedo a su disposición para seguir hablando de este tema y de los que ustedes gusten relacionados con las nuevas tecnologías e Internet. Pese a mi corta edad y mi falta de experiencia (apenas llego a cumplir 25 años) sí que tengo algo que muchos de ustedes carecen, y es haber nacido en plena era digital, haberme rodeado desde un primer momento de ordenadores, sistemas informáticos e internet, y esto está demostrado por sociólogos y psicólogos, proporciona una comprensión radicalmente distinta del mundo de aquellos que han tenido un acceso distinto, tardío, a este entorno digitalizado. Y esto no es bueno ni malo, simplemente entiendo que es mi deber como ciudadano hacerles llegar mi visión de la situación, desde una perspectiva que quizá a ustedes les puede suponer más dificultades comprender.

Espero que esta misiva no haya sido excesivamente larga ni pesada para ustedes y comprendan la urgencia de la misma y los motivos que me han llevado a escribirla, así como los que hayan podido tener los cientos o miles de personas que asimismo les han hecho llegar sus advertencias sobre lo que puede suponer la aprobación de dichas leyes.

Internet, las personas y lo que se avecina. II – Fuera de control

Tal y como venía comentando en la anterior entrada, hay un punto importante de choque entre los grandes intereses (económicos, se entiende. Por interés podría ser cualquier cosa que una persona quiere conocer, de hecho) de las corporaciones mediáticas tradicionales -y este es un concepto al que volveremos más adelante- con la mismo concepción de Internet como red abierta y libre de transmisión de contenidos sin jerarquización o criba real.

Obviamente que hay páginas que generan mucho más tráfico y, de entrada, la web del New York Times, por ejemplo, por ser un medio de comunicación preexistente, tiene muchos más usuarios que otras páginas particulares o de medios nuevos. Al principio del Internet de masas, y hablamos de la primera parte de la década de los 1990, cuando uno se conectaba a Internet (a la World Wide Web en concreto) y lo que encontraba eran, mayoritariamente, páginas web de grandes medios de comunicación, preferentemente americanos, fotos de la NASA y sus satélites y poquita cosa más. Mantener un servidor era caro, contratar un servicio de hosting, inalcanzable para la mayoría, de modo que, en esa época la cosa se queda así.

Al poco tiempo la competencia en la mejora de precios en los servicios de hospedaje y la aparición de algunos servicios de hospedaje gratuito de páginas web, como el histórico y ya desaparecido GeoCities nos permitían a nosotros, particulares de a pie, presuntamente sin dinero y nada que decirle al mundo (desde el punto de vista de los poderes…) darnos a conocer, mantener una página web con colores horteras y con un permanente icono de “en construcción”.

Y vino Google, San Google (y no me escondo al decirlo, ya lo sabéis todos, en otro momento explicaré el por qué de San) y nos permitió buscar rápidamente cosas en aquél batiburrillo de cosas, en su mayor parte sin importancia y elegir lo que realmente valía la pena, porque hasta entonces, encontrar algo de interés suponía pasar horas y horas desechando páginas hasta encontrar algo que pudiera valer la pena. Google nos hace ahorrar tiempo, es bueno, crece y empieza a popularizar, de forma masiva, una cosa que hasta entonces era medio experimental medio excéntrico, los blogs (para los técnicos, sé que me dejo muchíiisimas cosas por el camino, pero mi objetivo no es mostrar en detalle la historia de Internet. Para ello tenemos magníficas páginas que ya lo hacen, y mucho mejor que yo).

Ahora ya no sólo podía poner mi pedacito de historia en los bits si no que además la gente que lo viera podía decirme “¡hey, qué bueno!” y “vaya truño chaval”. Con ellos hay personas muy interesantes que, pese a no pertenecer a una empresa conocida a nivel mundial y no tener en su cuenta bancaria varios ceros detrás de un número, han podido explicar su visión del mundo en torno a algún tema en particular, y de todos es sabido que si algo funciona, la gente lo comenta y lo compra-visita-ve-lee-pongaaquísuverbo. Con los blogs eso no ha cambiado, y del mismo modo que si en una tienda me tratan mal no pienso volver a entrar, un blog donde publiquen tonterías no lo pienso volver a visitar, no así con sitios donde podemos encontrar contenidos de calidad y contrastados.

¿La diferencia? El 90, 95 o 99% de esos contenidos de interés los podemos encontrar en sitios creados y mantenidos por personas individuales, sin un interés real en manipular una información o despistar al personal, ya que cuelgan cosas por amor al arte. Y eso lo lleva muy mal el mundo del dinero…

Una empresa va a tratar, por sus mismos principios constitutivos y de base, de maximizar los beneficios a costa de lo que sea. Hoy está muy de moda lo de ser medioambientalmente responsable, y algunas empresas piden certificaciones y hacen algunos cambios en ese sentido, pero porque es rentable, que si no, ni soñarlo (en realidad la rentabilidad en este caso es social, lo cual aumenta la imagen de marca de esa empresa y es mejor valorada, de modo que las ventas, al final, probablemente aumenten, con lo cual, es rentable ser verde). Puesto que una empresa tiene que ser rentable, si hace falta mentir, no decir toda la verdad o ocultar alguna cosica pues, oiga, se hace y punto.

El problema está en que empresas hay muchas pero personas hay varios órdenes de magnitud más e Internet es un medio democrático y donde, de entrada, todo el mundo puede decir la suya y llegar a cualquier persona del planeta. Lo cual significa que por una publicación “oficial” hay 10.000 o 20.000 entradas de personas particulares o colectivos “disidentes” de esa opinión que te vienen a decir las cosas que aquéllos obviaron. No sé si me explico…

En cualquier caso, y volviendo al hilo de lo hablado, Internet, con el tiempo, evoluciona. Y se mejora. Y aparece Napster, una de las madres del cordero del por qué de todo esto. Resulta que hasta entonces, más o menos, uno podía escribir y leer en Internet, y escuchar música y ver películas en su ordenador. (Bueno, los que usábamos Windows por entonces, ya sabemos las limitaciones de ello hasta la aparición de Win XP…). Pues con Napster no, ahora resulta que puedo compartir mi música. ¡Mira! Esto sí que es bueno. Napster es un servicio distribuido para compartir información digital, lo cual quiere decir que puedo enviar mis archivos (lo que sea) a un servidor y cualquier otro puede buscarlo poniendo unas palabras clave en un motor de búsqueda y descargárselo en su ordenador y, ¡Voilá! ya es mío.

El fallo de Napster (y es lo que tiene ir en pañales y querer ponerse a correr de golpe) es que al ser toda la información tratada de forma centralizada en los servidores de la compañía, cuando la RIAA y demás representantes de grupos musicales (sobretodo) empezaron a poner demandas por violación del copyright no supieron donde esconderse. Dejando al margen que podríamos discutir sobre la legalidad y algunas carencias del juicio contra Napster, lo que sí se vio claramente es que ese servicio había abierto la puerta a cosas que nadie se imaginaba hasta entonces. Cerró Napster y aparecieron otros como réplica, esta vez sin un servidor centralizado y almacenando la información directamente en los ordenadores particulares y compartiéndolos mediante un sistema conocido por todos como P2P. Esto quiere decir, justamente, que yo tengo un documento en una carpeta de mi ordenador, accedo a esa red e indexo (paso un listado) de todos esos documentos con mucha información de ellos, de modo que en esa lista circula por ahí libremente para que cualquiera que ponga una palabra clave en su buscador y coincida con alguna de las que aparece en mi lista pueda acceder a mi ordenador para conseguir una copia íntegra de ese documento (más o menos, en resumen viene a ser eso).

Vaya, entonces, ¿por qué tengo que pagar 25 euros por un CD de música si me puedo conectar a Internet, a la Mula y bajármelo de gratis? De entrada puede parecer que hacemos algo ilegal, ya que se supone que tenemos que pagar por ello, aunque hay por ahí un artículo de la Ley de Propiedad Intelectual que dice que tenemos derecho a hacer copias privadas de cualquier material que sea susceptible de percibir royalties por derechos de autor (aunque esto está mal dicho, pero ese es otro tema), cumpliendo con unos requisitos como es el no lucrarse con ello. ¡Perfecto! Yo me quiero bajar el último disco de Alexandros Sances porque me gusta y quiero escucharlo todos los días y no porque quiera venderlo, vamos, con la pereza que me da fotocopiar la carátula…

Con el tiempo, descargarse algo de Internet se ha convertido en algo tan rutinario que nadie le da importancia. ¿Nadie? Una irreductible aldea con mucho poder resiste desde siempre al invasor… Y el resto es historia contada.

Sé que es un tema muy sobado en Internet (dónde si no), pero a la vista de las filtraciones y las informaciones que se dan cada vez más seguidas sobre el fin de la neutralidad de la red me veo en la obligación moral de transmitir el mensaje de preocupación que crece dentro de mi cada día que pasa.

Pese a haber conseguido paralizar en Europa el desarrollo del ACTA (Anti-Counterfeiting Trade Agreement, o Acuerdo comercial anti-falsificación) con una movilización nunca antes vista para convencer a los europarlamentarios de la necesidad de frenar ese acuerdo negociado en secreto y tras una cortina de inexactitudes y puntos ocultos, absolutamente incomprensibles en un parlamento democrático como es el Europeo, acabo de leer que la Comisión Europea y representantes de las empresas de comunicación están negociando cómo detener la expansión del Internet libre y sustituirla por una red adulterada donde pagaríamos por visualizar determinados contenidos y sólo determinados contenidos.

Quizá habría primero que poner en orden unas cuantas ideas y hacer un repaso de la historia para ver lo que ha sucedido hasta ahora, dónde estamos hoy y qué puede pasar mañana (especialmente si no hacemos algo activamente por evitarlo).

Me gustaría no extenderme demasiado con las entradas, así que dividiré esta presentación en unas cuantas partes para que sea más digerible la lectura. :)

Desde la década de los 60 se venía confirmando la necesidad de disponer de una red mundial (o por lo menos lo más grande posible) que conectase diferentes centros de saber, especialmente las bibliotecas y las universidades, de forma que la transmisión de datos entre ellas fuese lo más rápida y eficiente posible. Por supuesto, las primeras y rudimentarias versiones de la Red fueron mejoradas rápidamente y llegando cada vez más lejos. El correo electrónico se impuso rápidamente en todo el mundo como una de las formas más eficaces de hacer llegar contenidos privados a destinatarios particulares, y los foros de Usenet, que podían ser creados y mantenidos por cualquiera y que suponían un paso más allá de las listas de correo, dónde sólo podías recibir la información a la cual te habías suscrito en la bandeja de correo privada (y frecuentemente, incluso, saturarla), cada vez ganaron más popularidad.

Un foro, en definitiva, es un espacio más o menos libre dónde cualquiera (si así lo permiten las condiciones de uso) puede leer y comentar cualquier cosa que se esté debatiendo. En un foro como los de Usenet, que eran temáticos, los debates eran incontables, así como las opiniones que ahí se declaraban y las innovaciones que se comentaban y ponían en común.

Lentamente, esta forma de comunicarse, bidireccional, y no unidireccional, como venían siendo los medios tradicionales (prensa, radio y televisión), y dónde radica su diferencia, precisamente, se fue imponiendo, primero como un artículo, más o menos de lujo, a principios de la década de los 90, llegando a estandarizarse en España las conexiones a una ya más evolucionada red de Internet a partir de 1995 aproximadamente, con las conexiones vía módem y pago por minuto y, posteriormente, con las tarifas planas y la llegada del ADSL.

Antes de Internet sólo los propietarios de un diario, revista, radio o televisión (y similares) podían dar a conocer la información de forma masiva, al gran público. Debido a la necesidad de una gran cantidad de recursos económicos para poner en marcha una empresa de este tipo, generalmente las opiniones y la línea editorial de todos los medios está condicionada por el permiso de quienes sustentan ese medio de comunicación. Y, obviamente, nadie pretende tirarse piedras sobre su tejado, así que, en general, la información de los medios de comunicación tradicionales está sesgada, en uno u otro sentido, ocultando o mostrando información en función del interés de quien financia las palabras de los que escriben o hablan… Esto es así y ha sido así desde que la prensa escrita (y después la radio y la televisión) existen.

Con la aparición de Internet, una Red sin jerarquías y con la libertad inherente, en su misma estructura, de poder crear y acceder a cualquier contenido que en ella se halle, las posibilidades de mantenerse informado crecen de manera exponencial, especialmente cuanta mayor es la capacidad de las personas de acceder y crear nuevos contenidos, aportando variedad y valor a lo que podemos leer y conocer.

Por poner un ejemplo práctico. Supongamos que en mi pequeño pueblo de la Sierra soy el propietario del único periódico de información local. Supongamos, al mismo tiempo, que un amigo mío es propietario de una granja que, accidentalmente (o no), ha contaminado un acuífero que abastecía de agua potable al pueblo. Supongamos que un grupo de vecinos ha denunciado a este amigo por su acción, y yo, por protegerlo, intento ocultar alguna información que podría hacer que todo el pueblo se le echase encima y lo lapidase en público. Supongamos que ese grupo de vecinos se reivindica en internet, en un foro creado para los vecinos del pueblo, donde puedan hablar y compartir información… ¿Veis dónde empiezan a chocar los puntos de vista? Y esto es sólo la punta del iceberg y uno de los aspectos por lo que estamos cerca del principio del fin de la Red tal y como la conocemos hoy en día.

Nuevo curso

Y este año con novedades importantes, ya que me han dado una plaza para todo el curso en una escuela que hay cerca de mi (actual) casa. La verdad es que ha sido una carambola curiosa y todo el mundo me dice que me ha tocado la lotería, pero yo no acabo de tenerlo del todo claro, teniendo en cuenta las reservas que me produce pensar en la educación reglada, por lo menos tal y cono se entiende hoy en día.

En cualquier caso este año, con el cambio del calendario escolar y el adelantamiento del inicio de las clases estaremos desde el próximo martes 7 dando guerra con los niños y a ver qué sale.

Al mismo tiempo (y es que llevo una buena temporada sin escribir nada…), Xenia y yo estamos buscando un piso para alquilar e irnos a vivir pronto, que ya toca, después de 7 años largos y con vistas a una boda muy pronto.
Y a todo esto ahorrar para el terreno y la casa que construiremos en el futuro cerca de Igualada.

No, si os tengo que poner al día… ;-)

Pero va a ser que en otro momento, jejeje ;-)

Tomando algo

Últimamente Xenia y yo hemos ido algunos días -mejor dicho noches- a tomar algo a La Musganya, un bar que hay junto a la sede del Distrito de Nou Barris. Es de esos sitios que tienen juegos de mesa para entretenerse un rato.

Después de probar con el famoso Scrabble hoy hemos probado uno que todavía no habíamos jugado, el Palabras Arriba, que no ha estado nada mal. En la foto la vemos a ella desesperada por no conseguir las letras que le iban bien para hacer su jugada… jejeje

Parece que dentro de “poco” esas partidas pueden ser algo más habitual… “ya tú sae”… ;-)

Dentro de tres horas me activan el nuevo contrato con Yoigo, y realmente no sé qué tal será, pero desde luego tengo ganas de probar el Internet móvil. Ironías del destino, hoy este telefonillo desde el que os escribo ha decidido por sí cuenta que tenía ganas de conectarse a Internet un ratito, así que ya veremos la factura…

En cualquier caso está bien esto de poder escribir justo antes de dormir :-) lo único que espero es escribir entradas más largas que estas últimas, jejeje. ¡Buenas noches y hasta la próxima!

Explorando nuevos terrenos…

Como ya anticipé en el anterior post, intuyendo qué cambios se afectaban, aquí estoy, escribiendo tumbado desde la cama, cosa que no había hecho antes. Incluso ya había apagado el teléfono, pensando en irme a dormir, pero, como las embarazadas, he tenido un “antojo” y empeorar aquellos tiempos en que escribía en mí diario, ahora ya olvidado y sustituido por una versión con pilas y un poquito más “modenna” que la del candado bajo la cama.

Parecen buenos tiempos para las reflexiones de un día cualquiera… ¡Buenas noches! :-)

Novedades novedosas…

Tras mucho tiempo pensándolo estas últimas semanas, finalmente he decidido contratar una tarifa de datos para el teléfono y un HTC com Android (concretamente el Desire, jejeje). Creo que ahora postearé mucho más, tampoco he pensado sobre qué, pero me da a mí que… ;-)

El teléfono en concreto es lo último de lo último, y aunque nunca he tenido un smartphone me ha encantado desde el primer momento. Poder envianos una foto mientras escribo, por ejemplo, es una gozada, y desde luego, el terminal tiene miles de posibilidades, ya os contaré.
